1. Who you are contracting with

These Terms govern your use of KSG RealtorFlow (the "Service"), provided by KSG Technologies, LLC ("KSG", "we", "us"). By creating an account or using the Service, you agree to these Terms.

2. Eligibility and accounts

You must be of legal age and, if using the Service for an organisation, have authority to bind it. You are responsible for maintaining the confidentiality of your credentials and for activity under your account. You must provide accurate information and keep it up to date.

3. The Service

KSG RealtorFlow is a SaaS platform for real-estate professionals to manage leads, content, compliance review, and multi-channel publishing. Features available to you depend on your subscription plan.

You must not misuse the Service. In particular, you must not:

KSG retains all rights, title, and interest in the Service, including software, documentation, and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service within your subscription plan. You retain ownership of content you upload and grant us a limited licence to host and process it solely to provide the Service.

6. Payments and subscriptions

Payments are processed by Stripe Payments. With end-to-end compliance handling enabled, Stripe acts as our payment processor of record on each transaction, handling tax calculation and collection, fraud protection, chargebacks, and transaction-level customer support on KSG Technologies, LLC's behalf. Payment, billing, tax, cancellation, and refund mechanics are governed by Stripe's Consumer Terms of Service. Your bank statement may show "LINK.COM*" alongside our brand name.

Refund requests are handled in line with our Refund Policy.

8. Service level

We work hard to keep the Service running, but we do not guarantee uninterrupted or error-free performance. The Service is provided "as is" and, to the fullest extent permitted by law, we disclaim all implied warranties including merchantability and fitness for a particular purpose.

9. AI-generated content

The Service includes generative AI features. You are responsible for your prompts, how you use outputs, verifying their accuracy, and having the rights to any input content. Outputs may be inaccurate and are not suitable for regulated professional, legal, or financial advice without human oversight. We may filter or refuse outputs and may remove content or suspend accounts for violations.

10. Suspension and termination

We may suspend or terminate access for material breach, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service and cancel your subscription at any time. On termination, your right to use the Service ends and we may delete your data after a reasonable export window.

11. Liability

To the maximum extent permitted by law, our aggregate liability is capped at fees you paid in the 12 months before the event giving rise to the claim. We exclude liability for indirect, consequential, or special damages (including loss of profits, data, or goodwill). Nothing in these Terms limits liability for fraud, death, or personal injury where such limitation is not permitted by law.

12. Indemnity

You agree to indemnify KSG against claims arising from your content, unlawful use of the Service, or breach of these Terms.

13. Governing law

These Terms are governed by the laws of the State of Delaware, USA. Disputes shall be resolved in the courts located in Delaware, unless mandatory local law provides otherwise.

14. Changes

We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use after changes means you accept the updated Terms.
